| 摘 要： | 改革开放以来,我国教育法制建设取得了长足进步,但处于转型中的各法律关系主体的利益关系不断发生变化,而教育法制建设明显滞后于转型社会各法律关系利益调整的需要,特别是现行教育法律中存在不少瑕疵,严重影响了实施效果,因此,必须加快教育法制现代化的进程,完善教育立法机制;清理、修改现行教育法;加快《学校教育法》、《教育财政法》、《教育投入法》的立法,完善教育法制,让教育法为我国教育的现代化保驾护航。

| Abstract: | Although we have maken great progress in the construction of educational legal system since 1979,there are still many defects that sturt its effection in pratice,for example,the construction of our educational legal system is lagged behind need of bodies in it while their interest relationships change continuously wothin the social transformation Therefor,to alcelerate our modernization of education under a better educational legal system,We must speed up the modernization of our educational legal system by perfecting the legislative mechanism,clearing up and modifing the current educational laws and speeding up the course of legislations of the School Education Act,the Educational Finance Act and the Educational Investiment Act. |
