法人治理背景下公立高等学校与政府的关系

确立我国公立高校的法人地位是公立高校获得充分的办学自主权和独立开展各种民事活动的前提,也是重新厘定公立高校与政府间关系的基础。与私立高校相比较,公立高校与政府联系更加紧密。在法人治理背景下,要重新界定公立高校与政府之间的关系,就要排除行政干预对办学自主权的过度干预,充分保障公立高校的办学自主权。政府应从改革对公立高校的拨款制度和评估制度入手,将政府拨款与办学质量挂钩,实现评估制度的规范化,充分发挥这两项制度对公立高校的激励作用。

The Relationships between the Government and Higher Educational Institutes in the Context of Corporation Governance

To establish the position of the university as a corporation is the premise for a university to gain the right for the independent operation of higher education institute, and undertaking of civil affairs and it is also the foundation for the re-distinguishing of the relationship between the government and higher educational institutes. Compared with Private colleges, the public universities and colleges are much more closely related with the government. In the context of corporate governance, the over-interruption of the government should be diminished so as to ensure the independent governance of the universities and to redefine the relationship between the government and universities. The government should make full use of its systems of funding and quality evaluation to promote the development and operation of higher educational Institutes.
