| 摘 要： | 抵押登记行为的法律性质及其效力，以及登记错误的法律效果等问题是困扰司法实践的难题。抵押登记行为效力的立法体例选择与物权变动的立法模式密切相关。在形式主义物权变动立法模式下，抵押登记具有公信力；采用实质审查主义，登记机关应就自己的违法行为承担国家赔偿。

| Abstract: | The legal nature and effect of mortgage registration, and the legal effect of wrongful registration as well constitute the cruxes of the judicial pratice. Legislature system is closely connected with legislature model of the alteration of right in rein. Under the formalism legislature model of the alteration of right in rein, mortgage registration has the effect of credibility while the registration organs is supposed to assume the state compensation obligation for its owm delict under the ratification model of the alteration of right in rein. |
