| 摘 要： | 侵权责任法的功能不是单一的,而是多元的。侵权责任法的功能具有二元化的特点:一方面是规范功能,即对侵权人违法行为的惩罚和制裁功能,为侵权责任法的直接功能;对被侵权人损害的弥补和救济功能,为侵权责任法的核心功能。另一方面是社会功能,即维护社会稳定和促进社会和谐,为侵权责任法的终极功能。侵权责任法二元化的功能体系,是统一的和有机联系的整体,缺一不可,共同实现侵权责任法的立法价值。

| Abstract: | The function is not single,but diverse.Function of tort law has dual characteristics:one is to regulate the function,that the infringe penalties and sanctions function is a direct function of tort law;Compensating for the infringement and relief functions is Tort Law core functions.The other hand,it is social function,the maintenance of social stability and promote social harmony is the ultimate function of tort law.Tort Liability Act,dual function system is a unified and organic whole and indispensable,which achieve the value of law tort liability legislation. |
