论专利制度的本质

随着科技的进步和社会经济的发展，理论界对专利制度的关注和其本质的研究也越来越多。关于专利的本质，目前学界观点不一，有保护机制说、政策说、经济制度说等。在分析专利制度的理论、特征及其社会效益的基础上，解释了专利制度存在的原因，并得出专利制度的本质是价值观选择的结论。

On the Essence of the Patent System

With the development of science and social economy, more and more attention are attached to the patent system and its essence in the academia. There are different views about the nature of patent in academia, such as protection mechanism theory, policy theory, economic system theory and so on. Based on the analysis of the patent system’s, theoritical characteristics and its social beneifts, this paper explains the reason for the existence of the patent system, and concludes that the essence of the patent system lies in value choice.
