打击虚假诉讼的刑罚手段不能缺位——对设立“诉讼欺诈罪”进行规制的探究

近年来，当事人通过虚构事实、隐瞒真相等各种手段提起民事诉讼已屡见不鲜，这种虚假、恶意的民事诉讼行为不仅侵害了利害关系人的合法权益，还扰乱了正常的审判秩序，损害了司法的严肃性和权威性。本文通过对目前我国虚假诉讼的现状及成因的分析，提出打击虚假诉讼刑罚手段不能缺位的观点，并通过与诈骗罪、妨害作证罪、帮助毁灭、伪造证据罪等相关罪名的比较，对设立“诉讼欺诈罪”的刑法规制进行探究。

No Absence of Penalties against False Lawsuits ——on Establishment of Crime of Litigation Fraud

In recent years, it is not uncommon that people bring a civil action by various means of fictitious facts or concealing the truth, such false and malicious acts of civil litigation have not only seriously infringed upon the legitimate rights and interests of stakeholders, but also seriously disturbed the normal trial order, impaired the solemnity and authority of the administration of justice. In this paper, it makes an analysis of the status and causes of false litigation, and proposes that the penalties against false lawsuits cannot be absent, and also by comparing with other related charges including crime of fraud, prejudice to testify, and crime to help destroy and counterfeit evidence, it explores the optimal path for the introduction of the ＂litigation fraud＂.
