| 摘 要： | 《刑事诉讼法修正案》中存在权利宣示而无救济措施的法律规则结构断裂现象,它反映了秩序控制和权利保护的冲突和妥协,但是之于秩序控制本身的消极影响大于其积极意义。最优选择是尊重法律规则的内在要求,完整表述行为模式和法律后果。

| Abstract: | There exists the structure fracture phenomenon in the "criminal procedure law amendment" that the rules of law shows the right to declare but no relief measures,which reflects the conflict and compromise of the control order and right protection.However,because the negative influence is greater than the positive significance in terms of self-control of the order,the best choice is to respect the rule of law intrinsic request,and complete the expression patterns and legal consequences. |
