非人存在物的法律主体地位之否定

随着环境问题的日益严重,环境法学界有些学者以生态中心主义为理论基础提出法律要赋予一些非人存在物法律主体的地位。本文从法律主体的概念出发,在法律实证操作的层面分析非人存在物无法成为法律主体的原因。

The Negation of the Law Corpus Position of Non-human Existence

Along with the environment problem increasingly serious, some scholars of the environment law circles regard ecosystem center doctrine as the theoretical foundation and propose the law should give some non- human existence the position of the law corpus. This article sets out from the concept of the law corpus, and analyzes the reasons that non-human existence can't become the law corpus in the level of law substantial evidence operation.
