| 摘 要： | 未注册商标和注册商标均是商品的识别标志,其差别仅仅在于未注册商标未经核准注册,如以此阻却了未注册商标的商标权,有悖于商标保护中的公平原则,针对我国未注册商标的法律保护现状,拟从未注册商标的范畴、未注册商标法律保护的依据入手,论述我国未注册商标保护的必要性和现实性,这对完善我国商标保护制度具有重要的现实意义。

| Abstract: | Both registered and unregistered trademarks are used to identify products.The only difference between the two lies in whether they are approved or not.It is unfair to stop the using of unregistered trademarks because such a practice goes against the fair principle of trademark protection.This paper,aiming at the present condition of legal protection of unregistered trademarks,starts from the category and basis of legal protection of unregistered trademarks to discuss the necessity and reality of unregistered trademark protection.This is of important realistic significance in perfecting the system of trademark protection. |
