论精神损害及其赔偿的功能

精神损害就是民事主体侵害自然人、法人的民事权利,造成的自然人生理、心理上的精神活动和自然人、法人维护其精神利益的精神活动的破坏,最终导致精神痛苦和精神利益的丧失或减损。精神损害赔偿不具有填补损害之功能,而具有调整与抚慰之功能,除这两种功能之外,精神损害赔偿还具有一定的惩罚性。惩罚功能为精神损害赔偿的辅助功能。

On Mental Damage and Its Compensation Function

Mental damage refers to the infringement on the natural person's or legal entities civil right made by the civil subject, which leads to the destructureof the natural person's or legal entities mental activity in psychology and physiology, and the inability to protect his/her mental interests.Therefore, mental suffering and loss or reduction of the natural person's interests are resulted. The indemnity for mental damage cannot compensate for the damage already made but possess the functions of adjustment and comfort. Besides the two functions, the indemnity for mental damage, in some sense, is paid also for punishment, the complementary function.
