| 摘 要： | 目前，涉及学生体育伤害事故处理的法律法规有7部，但实际执行中却存在归责原则负面影响大、较适用的法规不能作为有效的法律依据、实际无法可依的问题。建议：适时引入无过错责任原则、公平责任原则以充实和弥补法律归责原则的不足；完善相关法律条款，最好单独立法。

| Abstract: | At present,there are seven laws and regulations can be used as the legal basis for deal with student sports injuries,but in the actual implementation,there are imputation principles of negative influences,applicable laws and regulations cannot be used as valid legal basis,and unable to meet the actual.It suggests that we should timely introduce the principle of liability without fault,and fair liability in order to enrich and make up for the deficiency of principle of legal liability,perfect related legal provisions and best independent legislation. |
