论独立学院的法律特征

独立学院是新形势下高等教育办学机制与模式的一项探索和创新。独立学院应具有独立的校园和基本办学设施，能实施相对独立的教学组织和管理，独立招生、颁发学历证书、进行财务核算，对外能独立承担民事责任。独立学院与高校的关系不是上下级的行政隶属关系，而是平等的民事主体关系，是普通本科高校按新机制、新模式与社会力量合作举办的本科层次的二级学院，是民办与公办的结合。

ON THE LEGAL FEATURES OF INDEPENDENT COLLEGE

Independent college is a new exploration and innovation in the mechanism of running schools under the new situation. An independent college should have its own campus and fundamental facilities,carry out in a relatively independent manner teaching organization and management,enroll new students and award diploma independently,conduct financial settlement and bear civil liability independently. The relationship between an independent college and its university is not that of administrative subordination,but that of equal civil entities. An independent college is run in a combined manner,i.e.,by the state and non-governmental sectors.
