我国职业联赛产权关系和法人治理结构之研究

运用制度经济学的有关理论,分析了我国职业联赛的产权关系和法人治理结构,指出：我国职业联赛产权主体“错位”,关系混乱,法人产权缺乏独立性,依附于行政权,产权的可交易性差;职业联赛法人治理结构不合理,委托人权利缺乏保障,“内部人控制”现象突出,激励约束机制“失效”。并提出完善我国职业联赛法人治理结构的对策：理顺联赛产权关系,建立现代企业制度;建立职业联盟体制,完善法人治理结构;健全激励约束机制,防止道德风险发生;推进外部制度创新,完善联赛相关市场等。

Research on Property Rights Relationship and Corporation Administrative Structure of Chinese Professional Sport Leagues

Applying the relevant theories of system economics,the author analyzed the property rights relationship and the corporation administrative structure of Chinese professional sport leagues and pointed out that the property rights relation of Chinese professional sport leagues is confusion,and the corporative property rights attach themselves to the political power.It lacks the independence and cannot smoothly trade with each other.In addition,the corporation administrative structure is irrational,and the rights of clients lack legal guarantee,the phenomena of "the inner control" is very prominent,and the incentive-constraint system is ineffective,and so on.In order to perfect the corporation administrative sturcture of Chinese professional sport leagues,the author also brings out some countermeasures as follows:making the property rights relationship definite and building modern corporate system;introducing the "league System"and perfecting the corporation administrative structure;amplifying the incentive-constraint system and preventing moral hazard of agents;promoting the system creation and perfecting the relevant marketing,etc.
