我国绿色贸易壁垒法律体系的构筑

绿色贸易壁垒是国际贸易中一种新的非关税贸易障碍.它是一把双刃剑,既对人类有益,又随时都可能成为发达国家限制进口发展中国家产品的贸易保护措施,这对我国而言既是挑战也是机遇.面对绿色贸易壁垒带来的机遇和挑战,我们必须正视绿色贸易壁垒的存在、正视环境措施对国际贸易的影响,充分认识到我国在环保与贸易之间法律协调的欠缺,趋利避害,将环境措施的贸易影响纳入环境立法中,采取积极的应时措施,并合理利用绿色贸易壁垒维护我国的合法权益.我国在发展绿色产品、改善环境管理制度的同时,应尽快完善国内有关贸易与环境立法,构筑我国完善的绿色贸易壁垒法律体系,促进国际贸易与环境保护的有机结合和协调发展.

Construction on the Legal System of Chinese Green Trade Barriers

The green trade barriers are a kind of new non-tariff trade obstacles in international trade.It is of benefit to mankind,or it may become the trade protective measure which the developed states restrict to import the developing states' products.It is both the challenge and opportunity.Faced with the opportunities and challenges the green trade barriers brought about,we should envisage the existence of green trade barriers,envisage the influence of environmental measures to international trade,and realize the lack of coordination of law between environmental protection and trade.In the meantime,we should put the trade influence of environmental measures into the environmental legislation,take the active countermeasures,and use the green trade barriers to preserve our legitimate rights and interests.To develop green products and improve the environmental management system,we should perfect the trade and environment legislation,construct the green trade barriers legal system,and promote the organic integration and coordinated development of international trade as well.
