| 摘 要： | 孔子在＂仁＂和＂礼＂的基础上,提出＂德主刑辅＂,主张以＂德政＂为手段,恢复＂礼治＂秩序,董仲舒从＂天道＂出发,以＂三纲五常＂论为基础,提出＂阳德阴刑＂的思想,继承并发展了由孔子创立的儒家法学思想。

| Abstract: | Based on＂benevolence＂and＂rites＂,Confucius proposed supplementing punishment to benevolence and advocated ＂benevolence＂as a means to restore＂Rites＂order.And Dong zhongshu started with the＂Heaven Rules＂and based on the ＂Three Orders and Five Virtues＂to propose＂preferring benevolence to penalty＂mentality,which inherited and developed the law thoughts of Confucianism founded by Confucius. |
