产权式酒店经营中投资者利益保护探究

投资者将产权式酒店统一委托给酒店管理公司进行经营,信息的不对称性,决定了投资者的弱势地位。如何对酒店管理公司进行监督,投资者如何更换酒店管理公司以及如何退出产权式酒店的投资,这些问题是产权式酒店在经营过程中所必然面对的问题。由于目前国家没有针对产权式酒店的专门立法,建议根据我国物权以及信托的相关的法律法规的相关规定,有针对性的解决这些问题。

The investors entrust their property-typed hotel to the hotel management company.The asymmetry of information determines the disadvantaged status of the investors.How to supervise the hotel management company,how to replace the hotel management company by the investors and how to exit the hotel property investment are inevitable problems in the course of the property-typed hotel business.Since there is no specific legislation for the property-typed hotel at present,it is recommended that some programs related to these issues should be proposed according to the relevant laws and regulations of China’ property right and trust.
