| 摘 要： | 在未成年人犯罪治理中引入前科消灭制度,可以充分发挥刑罚的教育和预防功能,实现未成年人利益最大化的特殊保护原则。未成年人前科消灭的性质是前科身份及其法律后果的消灭,我国应在适用对象、范围、实质条件以及程序方面率先进行立法建设。同时,司法机关及社会公众也应为该制度提供有力的制度保障和心理支撑。

| Abstract: | Induction of Elimination system of Criminal Record in governing juveniles＇crime can achieve the special-protection principle which maximizes the benefit of juveniles through full utilization educational and preventional function of penalty fully.The character of Elimination of Criminal Record in juveniles＇crime is not elimination of crime fact but legal effect.In our country,we should take measure on lawmaking which include object,range,essence and precedure of the system.At the same time,judicial authority and social public also should provide powerful guarantee both in system and in psychology. |
