| 摘 要： | 基于保障意志自由、完善民法体系、更大范围解释物权变动现象等理由，应该承认我国立法上采取了独立的物权行为。在这一背景下，登记不仅仅是不动产物权变动的生效要件，而且是包含物权合意的物权行为的生效要件，是一事实行为。

| Abstract: | Based on reasons such as the protection of will freedom, improvement of the civil law system, better interpre- tation of the phenomenon of property right alteration, we should admit that in our country＇s legislation on real right alteration we take an independent juristic acts of real rights. In this situation, registration is not just the condition valid to the real estate alteration, but also an element valid to juristic acts of property. The real estate registration is the factual behavior. |
