从“无处分权”角度谈不动产物权的善意取得

摘    要:由于对善意取得适用范围的不同理解,传统善意取得制度的构成要件大多已遭质疑,因从“出让人无处分权为处分行为”这一唯一尚为定论的要件入手,用处分权理论分析不动产物权善意取得问题,认为,不动产物权由于登记的公示效力,对善意第三人构成有权处分,不宜适用善意取得.不动产登记公信力制度基本涵盖了善意取得制度的所有功能,且更具操作性,因而特别规定不动产善意取得实为立法之重复.
