| 摘 要： | 第三人侵害债权是指债的关系以外的第三人故意实施侵害债权人债权并对其造成损害的行为。虽然债权是一种相对权,但债权本身具有不可侵性,可以作为侵权行为的客体。我国应借鉴第三人侵害债权制度,明确界定第三人侵害债权的构成要件,保护债权人的合法权益。

| Abstract: | The third person encroaching on creditor's rights is the behavior that the third person encroaches on creditor's rights and that do harm to it on purpose. Though creditor's rights are a kind of relative right, creditor's rights can't have invading nature, can be regarded as the object of the tort. Our country should draw lessons from the third person and encroach on the system of creditor's rights, define the composition condition that the third person encroaches on creditor's rights clearly, protect the creditor's legitimate rights and interests. |
