新的《普通高等学校管理规定》取消了“勒令退学”,保留了“开除学籍”。文章结合这二类处分的概念与内涵,从处分情形、人权维护、遵守法律和学校管理权限以及现代管理要求等几个方面分析认为,对原有学生管理规定进行相应调整是必要的,但应取消的学生处分应是“开除学籍”而非“勒令退学”。“开除学籍”剥夺了人的受教育权,侵害了人的基本人权,超越了学校的管理权限。

A Question on the Rule of Dismissal Punishment in College Students' Management Provision

The author analyzes the concepts and implications of "Mandated Dropout"and "Being Expelled from School",cancelled and retained in the new "College Students' Management Provisions",in which the six-grade punishment is degraded to the five-grade.The paper argues that,in terms of punishing events,human rights,law and a college's authority,the"Being Expelled from School" rather than the "Mandated Dropout"be removed from the "Provision",for it deprives one of the right to education and encroaches on one's basic right to education,which will only be decided and implemented by law and its enforcing departments.
