摘 要: | 房产优先购买权是特定主体在房产交易过程中,在同等条件下依照法律、法规的规定享有优先于其他人购买出卖人房产的权利。本文通过对房产优先购买权的理论梳理,在比较击的视野下结合我闺的现行立法和司法实践。针对我国房产优先购买权冲突的现状,提出了解决房产优先购买权冲突的合理规则和立法完善建议。

Abstract: | House property right of preemption is a right of a certain party's purchasing seller's house property prior to others according to laws and regulations under the same conditions in the course of house property trading. In accordance of the theory of the preemption of the house property right, this article puts forward a reasonable rule and legislative perfection advice on solving conflicts of the preemption of the house property rights for their current status, in the view of comparative laws combining with our country's current legislation and judicial practice. |
