| 摘 要： | 共同犯罪中存在着犯罪停止形态的问题,对于共犯人的犯罪形态应结合共同犯罪的理论和刑法总则中关于故意犯罪的停止形态的规定予以认定。本文重点探讨了共同犯罪中实行犯和非实行犯的犯罪未遂、以及犯罪中止的问题。

| Abstract: | This is an issue about cessation pattern in complicity. As for the criminal pattern of accomplices, we should use the complicity theary togther with the regulatimes about the cessation pattern of calculated crime in the general provisions of criminal law to recognize. This essay stuied speially about exeutors or now - exeutors' attempt of cnime and dislontinuanle of crime in complicity. |
