| 摘 要： | 我国"案件事实清楚,证据确实充分"的刑事证明标准追求的是客观真实,在理论上存在着难以克服的缺陷,在实务中陷入无法解决的困境。本文拟对我国刑事诉讼证明标准的重构进行探讨并提出一些建议,以供大家参考。
