数据权益：我国体育赛事直播节目私法保护的另一种思路

体育赛事直播节目保护是我国体育产业健康可持续发展的重要支撑,但是现有保护方式仍存较大争议和诟病。综合运用文献资料、比较研究等方法探讨体育赛事直播节目“数据权益”保护的路径。研究认为：体育赛事直播节目在表现形式上多以非结构化的数据方式存在,可视为赛事组织者及其授权方对其合法拥有的比赛实时数据进行控制和处理的权益。在我国诸多法律相继纳入数据权益保护条款以及“加快培育数据要素市场”的大背景下,将体育赛事直播节目保护的请求权基础转向数据权益,援引数据权益保护的规范基础,更符合大数据和人工智能时代体育赛事直播节目保护之所需,有效弥补现有保护机制的不足,也有利于推动司法裁判规则的统一。

Data rights: another way of the private law protection of live sports transmission in China

The protection of live sports transmission is an important support for the healthy and sustainable development of China''s sports industry, but the existing protection methods are still highly controversial and criticized. This study explores the protection of data rights of live sports transmission using a combination of literature and comparative research. The study concludes that Live sports transmissions are mostly in the form of unstructured data in terms of presentation and can be considered as the right of the event organiser and its authorised parties to control and process the collection of live match data in their legal possession.In the context of the inclusion of data rights protection provisions in many Chinese laws and the "accelerated cultivation of the data elements market", the basis of the right to claim for the protection of live sports transmission is shifted to data rights, and the normative basis of data rights protection is invoked, which is more in line with the need to protect live sporting transmission in the era of big data and artificial intelligence, effectively making up for the shortcomings of existing protection mechanisms, and is also conducive to promoting the unification of the rules of judicial adjudication.
