浅析我国死刑审判程序相关制度的完善

我国最高人民法院收回死刑复核权意义重大,但死刑审判程序的一些相关制度仍存在不足之处,为便于死刑案件的审理,贯彻"少杀、慎杀"的政策,充分保障人权,必须对相关制度予以完善。包括将死刑案件被告人集中关押、扩充死刑案件审判合议庭、实行合议庭的绝对通过原则、完善死刑案件的二审及复核程序的审理期限等方面。

Analysis of the Improvement of Related Systems on China’s Death Penalty Judgement Proceedings

China’s Supreme People’s Court withdraws competence for judicial review of death sentence,it is of great significance.But some related systems on the proceedings of death penalty judgement are still inadequate.In order to facilitate the judgement of death penalty cases,carry out the "kill fewer,kill prudent"policy,protect human rights fully,the related systems must be improved.Including putting the accused persons on death penalty cases into prison concentrated,expanding the collegial panel for judging death penalty cases,implementing the collegial panel’s principle of absolute pass,protecting the hearing period of the second-instance and review procedures on death penalty cases.
