| 摘 要： | 以西安“宝马体育彩票案”为案例,通过对我国《合同法》、《刑法》等法律、法规的研究,对该案中承销合同的效力、罪犯杨永明的定罪等相关问题进行分析。结果表明:西安市体彩中心与杨永明签订的彩票发行承销合同属于无效合同;罪犯杨永明的犯罪行为不符合诈骗罪的犯罪构成,应以贪污罪和行贿罪定罪处罚。并且就加快彩票立法的进程、在刑法中增加彩票犯罪的新罪名、改革彩票发行体制、完善监管机制及加强法制与廉政教育等方面,对如何重建我国彩票信誉进行了思考与探讨。

| Abstract: | In the paper, the authors took example for Xi'an BMW sports lottery case, and through studying the Contract Law and Criminal Law in China, analyzed the validity in Xi'an BMW sports lottery case, and the guilty of criminal Yang Yong-ming. The analysis showed that: the contract of sports lottery issue and sale signed by Xian sports lottery center and Yang Yong-ming is invalided. The crime of Yang Yong-ming is not corresponding with bilk crime, his conviction should be accepting bribe. And improve the process of sports lottery legislation, add lottery criminal accusation to "penal law", reform system of lottery issue and supervision, strengthen education of legal system and honest official etc., and rebuild the reputation of lottery in our country. |
