采用文献资料法、逻辑分析法,从法理学的角度揭示运动员肖像权商业利用中出现的问题,人格权法保护的不足,提出公开权的概念、特征及其法律保护问题,认为应对具有财产性质的人格权提供保护,规范运动员肖像权商业利用的市场,保护运动员的合法权益。

A Research on the Athlete Portrait Right in Commercial Utilization--The right of publicity discussed concurrently

From the view of the law,with the method of document and logic analysis,the authors revealed the problem existing in commercial utilization,in-troduced the concept and characteristics of the right of publicity. In order to standardize the market where the athlete right of portrait in commercial utiliza-tion is common,we should protect the legal rights and interests of athletes.
