瑞士最高法院体育仲裁裁决重审的适用分析

瑞士法中的裁决重审是与撤销裁决并列，单独构成一种仲裁异议的特殊补救方式。运用文献资料法、案例分析法等方法，探讨国际体育仲裁裁决重审的适用，以期为国际体育仲裁当事人恰当运用这一制度维护权益提供参考。裁决重审在程序性要件上需要满足严格的裁决本身要求、事由要求、时限要求，方可能受理。在实体性要件上，基于"新的事实或证据"需要满足"新事实或证据发生在裁决结束之前、真实性无异议、有重要影响、尽了勤勉义务"等要件；基于"裁决受到犯罪行为之影响"需要满足"犯罪行为得到确认、犯罪行为有效影响仲裁结果"等要件；基于"事后发现提出异议的理由"需要满足"尽了勤勉义务、存在公正性客观怀疑、无其他法律救济"等要件。

Applicable Analysis of Sports Arbitration Awards of Swiss Supreme Court

Revision of an award in Swiss law is juxtaposed with setting aside an award and constitutes a special remedy for arbitration challenges on its own.Through literature study and case analysis,this paper discussed the application of the retrial of the international sports arbitration award in order to provide reference for the parties of the international sports arbitration to properly use the system to safeguard their rights and interests.The study concluded that revision of an award required strict requirements of the award itself,the subject matter,and the time limit to be accepted.In the substantive elements,“new facts or evidence”generally required that“the new facts or evidence occurred before the conclusion of the award,their authenticity was not disputed,they had a significant impact,and the duty of diligence had been exercised”.“Arbitration award being affected by criminal acts”generally needed to meet the requirements of“criminal acts being confirmed,criminal acts effectively affecting the arbitration results”.“Reasons found afterwards for objection to the arbitrator”needed to meet the requirements of“diligence,objective doubt of fairness,no other legal remedies”.
