我国体育仲裁的立法主体及立法依据

采用文献资料法,认为国务院有权成为我国体育仲裁的立法主体,这既是由体育仲裁调整的社会关系决定的,也是由体育仲裁自身特点决定的,而且符合立法第8条的规定.依照<行政法规制定程序条例>的规定,我国<体育仲裁条例>可以由国家体育总局负责起草,由国务院发布实施.根据社会主义法制统一的原则,国务院的体育仲裁条例必须与其上位法相一致,其立法依据是:宪法、立法法、仲裁法、体育法及相关民事法律(狭义),并参照国际公约和国际惯例,与国际接轨.

Legislative Subject and Basis of Sports Arbitration in China

Using Literature method it holds that the State Council has a right to become a legislative subject of sports arbitration in our country,which depends on not only the social relation of sports arbitration adjusted,but the characteristics of sports arbitration itself,and is conformity with the eighth stipulation in legislation.According to the stipulation of "Regulation of Administrative-Statutes-Making Procedure","Sports Arbitration Regulation"of our country can be drafted by General National Bureau of Physical Education & Sport and be promulgated for enforcement by the State Council.In the light of the principle of socialist legal system unification,the regulation of sports arbitration formulated by the State Council must rest on higher-grade laws,the legislative basis of which should be constitution,legislative law,arbitration law,sports law and the civil laws concerned,and ought to refer to the international conventions as well as be in accordance with the international usual practice.
