足球“黑哨”问题法律探析

足球裁判吹＂黑哨＂的行为是被禁止的,然而在近年的中国却尤为盛行。因此,如何更好解决足球＂黑哨＂问题,给足球运动创造一个公平、公正的空间是大家所期待已久的。通过从龚建平案件着手,用法律的眼光来审视,且介入刑事司法活动,从主客观方面和社会危害性的角度来分析,得出吹＂黑哨＂行为应该受到刑罚处罚,最后提出了一系列相关解决措施。

On the Legal Aspect of Black Whistle Issues in Football

The action about ＇Black Whistle＇ blowing by the football referee is prohibited,whereas in recent years the action is becoming popular in the Chinese society.So what is expected so long by us is how to solve this question about ＇Black Whistle＇ in order to create fair and equitable atmosphere in the football.This paper begins from the ＇Gong Jianping Case＇,with the vision about the law to rethink,especially using the criminal justice activities to intervene.From the perspective of the subjective and objective aspects and the social harmfulness,the paper points out that the ＇Black Whistle＇ blowing should be punished by the criminal law.In the end,the author gives some advices about this question.
