专利侵权损害赔偿政策与制度的改进——以专利侵权的过错类型为依据

 根据侵权人的过错程度，可以将专利侵权分为轻过错专利侵权和重过错专利侵权。如果将专利侵权过错分类制度移植入我国的《专利法》，就可以依据专利侵权的过错类型改进我国的专利侵权损害赔偿政策，再依据专利侵权的损害赔偿政策改进我国的专利侵权损害赔偿制度。通过专利制度价值分析后发现，新政策与制度较之当前的政策与制度能够更好地实现专利制度的正义价值、效率价值和创新价值。

The improvement of policies and institutions of damages for patent infringement --based on the fault types of patent infringement

Based on infringer's degree of subjective fault,patent infringements can be divided into two parts: slight-fault patent infringement and serious-fault patent infringement.By analyzing the different legal attributes of slight-fault patent infringement and serious-fault patent infringement,this article put forward different policies of damages for the two types of patent infringement;then by the directions of the different policies of damages,the article put forward different institutions of damages for the two types of patent infringement.Finally,after the value analysis of patent system,we can see that compared with current policies and institutions,the improved policies and institutions can do better in realizing justice value,efficiency value and innovation value of patent system.
