| 摘 要： | 由合同解释的由来入手系统介绍了表示主义理论和意思主义理论的基本情况 ,从对比分析中得出了对我国合同解释的看法。以表示主义的理论为基础 ,坚持以探求假定的当事人思想为目的 ,采用表示主义理论中由阐释到推定的合同解释规则 ,探讨了《合同法》的相关问题。

| Abstract: | Beginning with the introduction to the origin of the interpretation of the contract,the author introduces something basic about the Will theory and the Express theory.From the comparison and the analysis,we could conclude that the interpretation of the contract law should be based on the Will theory,be aimed at pursuing the supposed will and adopt the rule which is from clarifying to reasonling.At last,the paper ends with the discussion about the success and the defect of the Contract of Peoples' Republic of China. |
