试论洗钱罪的构成特征

随着全球经济一体化的发展，洗钱犯罪成为危害极其严重的国际性犯罪。近年来 ，此犯罪又在我国悄然兴起，给我国社会政治、经济造成极大危害。为适应打击洗钱犯罪的需要，我国新刑法增设了洗钱罪，但要准确地认定和惩治洗钱犯罪，必须把握此罪的构成特征

On the characteristic of money laundering

Money laundering is a kind of world-wide crime. In light of the Criminal law (1997),the author uses criminal law theory to make a research about the objective and subjective constitution of money laundering crime. Among this, the author pays much attention to the crime object and crime subject of money laundering crime as well as the relationship between money laundering crime and upstream crime. The author holds the idea that the crime subject of upstream crime is identical with the crime subject of money laundering crime.What this crime infringes is not the financial order, or social order but the nomal activities of judicial organization of the country.
