| Abstract: | Whether a kind of medical treatment behavior constitutes medical malpractice crime is determined by two key factors: whether or not one medical treatment behavior satisfies the constructing elements of a malpractice crime;differences between various types of situations in medical practice should be made clear from the perspective of judicial practice,that is,whether an action is guilty or not,whether this crime is different from that crime. |
