| 摘 要： | 债的逻辑和结构体系是自给自足的,然处于债的概念下级位阶的债的发生原因却因社会生活的变化产生了新的内容,集中表现在非典型之债的出现。非典型之债是指在民商事法律规范中,基于法律的直接规定而产生的、未被民法典债编典型之债所涵盖的债的关系。从非典型之债的内在本质和外在特征可甄别非典型之债,进而厘清对非典型之债的认识误区。

| Abstract: | The logic and structure of the debt′s system is self-sufficient.However,the cause of debt which low-level ranking of the debt has some new contents along with society′s immense changes.It focuses on the emergence of the atypical debt.The atypical debt refers to the debt relationship which issues from direct provide of the law,and has not completely covered by the typical debt in chapter of obligation law in civil law code.We can distinguish atypical debt from its internal nature and external characteristics to clarify the misunderstanding of the atypical debt. |
