试论物权观念的历史演进

现代物权观念已由近代物权法的所有为中心转化为利用为中心；以利用为中心的物权观念主要体现为物权的社会化及价值化，并与可持续发展问题密切相关；以利用为中心的物权观念对指导我国物权立法有重要的现实意义。

针对中国在物权法中是否承认物权行为的激烈争论，文章提出“到底什么是物权行为？”“它在立法中的出现是立法者的选择吗？”等问题，并期望通过从不同层面去剖析物权行为的含义和寻找它在立法中的位置，从而来获得一个解答。

公示公信作为当代物权变动制度的核心原则之一 ,在现代物权法中具有不可替代的地位。本文通过对我国物权变动中公示公信制度的法律现状和问题之分析以及当代物权变动中公示公信制度立法模式之衡量 ,指出我国有关物权变动中公示公信制度立法所应采取的模式 ,以及采取该模式时所应解决的几个问题 ,以期有助于我国物权法律制度的建立和完善

中国民法法典化进程中很重要的立法是物权法，物权法中极其重要的一项制度就是物权变动制度。由于世界各国立法对物权变动模式选择之多元化，围绕我国物权立法之物权变动价值取向问题，学术界存在激烈的争论。借用比较的分析方法，对学术界公认的物权变动两大价值——安全与效率进行定位，并以此为切入点检讨了世界范围内的四种物权变动立法模式：意思主义、债权形式主义、物权形式主义、折中主义。希望有助于我国物权法律制度之完善。

现代各国立法、租赁权都呈现物权化倾向，只是表现不一。租赁权物权化的实质是占有的效力所致和法律拟制的结果，并非租赁权本身的效力。我国立法肯定了租赁权物权化，但只是最低限度地体现了这一趋向，不动产租赁权却在弱化。

《物权法》第九条第一款采用＂登记生效主义＂的不动产物权变动规则忽略了占有在不动产物权变动中的法律地位,既不符合现实不动产交易的需求,也与其他法律法规存在矛盾与冲突,给司法实践中如何适用不动产物权变动规则带来困扰。物权公示与物权变动是两个不同层面的问题,其属性完全不同;交付占有作为不动产物权变动的方式符合安全、效率、公平的价值;从相关立法规范考察,我国法律法规和最高人民法院的司法解释以及外国不动产物权变动立法都赋予了交付具有重要的意义。我国物权法应明确交付在不动产物权变动中的法律效果,交付要件主义加登记对抗主义的不动产物权变动模式应是我国立法和司法的理想选择。     

我国应当采纳物权行为理论

物权行为理论从建立之日起，就引起了巨大的争议，而是否承认并采用物权行为理论，是物权立法乃至整个民事立法必须解决的基本的技术问题之一。作者从分析物权理论的后果与其他制度相比较，结合现实的具体情况，论证物权行为理论的合理性，并建议我国立法采纳。

Let F be a class of graphs G such that F={G|K(G) is a tree}. In this paper the graphs in F having independent clique-transversal sets are shown and thus TC (G)/|G|≤1/2 for all G ∈ F.
