我国《学校教育法》制订的现状与展望

自改革开放以来,我国已相继颁布了《教育法》、《义务教育法》、《职业教育法》、《高等教育法》、《民办教育促进法》、《教师法》等八部有关教育的法律与法规,但至今尚未制定教育领域中涉及对象范围最广、人数最多、作用最为重要的《学校教育法》.然而,制订《学校教育法》是现代学校制度建设的基本要求,是促进学校权责分明机制建立的必要保证,是明确学校法律地位的内在需要,也是处理学校安全事故的权威依据.当前,《学校教育法》的制定具有丰富的国际经验和实践基础.《学校教育法》的早日出台,已不仅是学校的心声,还是保障年轻生命及其教育权益的必需.

《教育法》是贯彻执行教育方针、教育政策,推进我国教育改革的法律保障。有法必依,执法必严,违法必究,才能显示法律的威严和效力。 《教育法》第十二条规定:“汉语言文字为学校及其他教育机构的基本教学语言文字。……学校及其他教育机构进行教学,应当推广使用全国通用的普通话和规范字”。

论社会转型与教育法制现代化

改革开放以来,我国教育法制建设取得了长足进步,但处于转型中的各法律关系主体的利益关系不断发生变化,而教育法制建设明显滞后于转型社会各法律关系利益调整的需要,特别是现行教育法律中存在不少瑕疵,严重影响了实施效果,因此,必须加快教育法制现代化的进程,完善教育立法机制;清理、修改现行教育法;加快《学校教育法》、《教育财政法》、《教育投入法》的立法,完善教育法制,让教育法为我国教育的现代化保驾护航。
