辩护律师调查取证权的保障研究

新《律师法》对律师的调查取证权做了较大修改,进一步增强了律师的权利,但法律的立法体现并不等于法律的司法实现,律师的调查取证权利目前还存在着多重障碍,首当其冲的就是刑事实体法的立法障碍。通过对辩护律师调查取证权内容的概述,同时结合《刑法》第306条的规定,研究探讨辩护律师调查取证权存在的主要障碍,并对辩护律师调查取证权的保障问题提出建议。     

律师伪证罪的立法问题分析

我国刑法律师伪证罪的设置存在众多问题,主要表现在犯罪主体具有特定指向性、罪状具有模糊性与宽泛性和《刑法》第306条与其他条文间存在相互的包容性。同时,本罪的设置带有职业歧视性色彩,违背立法理念。要解决存在的这些问题,建议废除本罪,或者修订主体和罪状,建立和完善律师惩戒制度,转变观念,确实保障律师权利。     

刑法第306条立法之妥当性质疑

对1997年新《刑法》第306条规定的“辩护人、诉讼代理人毁灭证据、伪造证据、妨害作证罪”，刑法理论界和司法实务界存在着较大的争议。本文作者认为，《刑法》第306条的规定有违刑事立法的经济性、明确性原则，与世界各国有关律师刑事责任的规定和有关证据犯罪的立法精神不符，实践上会产生不利于控、辩、审均衡诉讼结构形成的后果。     

论律师的执业豁免权

律师的执业豁免权在国外法律中已较为普遍被规定,但是在我国却迟迟没有涉及,这给我国的司法实践带来许多不利的影响,很重要的一方面就是刑事辩护律师的人身安全被忽视,同时由于刑法第306条的规定,我国的律师处境堪忧.为弥补这一缺憾,根据我国签字的国际公约和我国的相关立法,并结合2008年6月1日颁布实施的新《律师法》,笔者提出应赋予我国的律师以执业豁免权.

在刑事诉讼中，辩护律师人身权是律师一切权利的基础。我国相关法律对此却规定得不够明确，缺乏可操作性，一些重要权利甚至未予认可，以致辩护律师在执业过程中人身权遭到侵害的案件时有发生。我国应在借鉴其他国家保护辩护律师人身权制度的基础上，完善我国辩护律师的人身权保障。

律师的刑事辩护容易遭受指责甚至攻击,这是世界性的问题。而中国问题的特殊性在于,中国刑事辩护律师遭受的并不是或主要不是制度问题,对律师职业性质和地位的扭曲认识是使制度建设成本增大并难以达到预期效果的重要原因之一,所以,应从律师的职业性质界定入手,使公众尤其是法律职业共同体成员对律师的职业性质和辩护律师的地位、作用及其对于理性秩序建构的价值达成正确认识,才能使制度建设和运行获得公众心理支撑,使制度进步获得更实际的意义。     

"律师伪证罪"的反思与选择

《刑法》第306条单独设立“辩护人、诉讼代理人毁灭证据、伪造证据、妨害作证罪”给律师的执业带来无法回避的执业风险，违背了律师执业的基本规律。本从司法实践、立法技术、价值取向层面分析了单独设立该罪导致的误区和缺陷。提出对该罪进行科学的反思，对其存废作出理性的选择，并对相关法条作出技术性调整。

自从辩护律师调查取证权构建以来，调查取证难的问题一直在实践中难以解决。在近年刑事司法改革的视野下，充分落实辩护律师调查取证权具有重大意义。推进刑事司法改革视野下辩护律师调查取证权的充分落实，可以从权利本身出发，充分保障自行调查取证权和申请调查取证权，从实践问题出发，赋予值班律师调查取证的权利，从未来路径出发，探索律师调查取证的新途径。
