司法实践析例二题

自首,是我国《刑法》中一项重要的量刑制度。本文就自首制度在司法实践认定中的两个有争议的问题,阐述了自己的看法,认为犯罪嫌疑人如能在“被传唤归案”后、采取“强制措施”前主动如实供述自己的犯罪事实,应当认定为自首。同时,就《刑法》第六十七条第二款规定的应当认定为自首的“其他罪行”,谈了自己的看法,认为此处“其它罪行”仅指司法机关已掌握的罪名以外的“其他罪行”,而对犯罪嫌疑人主动供述的司法机关已掌握的同种罪名的余罪事实的行为,应当认定为“坦白”。     

内地与澳门刑法绑架罪比较研究

为了更加有效地惩治绑架犯罪，有必要以比较的方法对绑架罪进行研究。本文拟就内地刑法与澳门刑法中绑架罪罪名、犯罪构成、处罚等方面进行分析比较，以期对我国相关问题的解决有所借鉴。     

也论绑架罪的几个问题

重点论述了刑法第二百三十九条规定的罪名确定应为绑架罪和偷盗婴幼儿勒索罪，我国刑法绑架罪实行行为不包括欺骗及要挟行为以，及强索法律不予肯定的债务明显超出实际债务的定性及“明显”之认定等。     

罪名拟定的原则

罪名拟定必须坚持概括原则、文本原则、协调原则、准确原则。概括原则是指罪名应当简约、精炼。文本原则是指拟定罪名应当尽量使用罪状中的表述词汇。协调原则要求罪名之间应当协调一致,相似、相近罪名应当呈现出规律性。准确原则是指罪名应当反映罪名的本质特征,不能出现罪名的外延大于或者小于罪状的情形,更不能产生歧义。新通过的《刑法修正案(八)》涉及的争议罪名,运用如上四个原则拟定,会得出恰当结论。

在我国刑法分则中,犯罪类型的设置存在着重大的粗细错位,该粗的不粗,该细的不细。因此,在今后刑法修订中,应当纠正犯罪类型设置粗细严重错位的立法思路。在重大法益的保护上,尽量采用详细具体的罪名,在轻微法益的保护上,尽量采用类型化的罪名,做到该粗的则粗,该细的则细,才能最大限度实现刑法的目的,发挥刑法的机能。     

我国新时期反恐刑法立法宏观问题论要

尽管《刑法修正案(九)》的通过已极大丰富了反恐怖罪名体系,但我国反恐刑法立法在价值取向、模式选择、体系定位、罪名设置等宏观问题仍有诸多值得探讨之处。现代刑法所坚持的保护社会和保障人权并重并适当向保障人权倾斜之价值立场,应该在反恐领域得到一体遵行。对于反恐刑法立法的完善主要应采用刑法修正案的形式,但当涉及分则条文体系的调整时,则只能求诸全面、系统的刑法典修订之模式。刑法分则危害公共安全罪一章可以分为五节,而恐怖主义犯罪应在其中占有一席之地。同时,应单独规定实施恐怖活动罪,作为恐怖主义犯罪的基本罪名。     

贿赂犯罪罪名的国际比较——以中国、日本和联合国为例

贪污、贿赂等腐败现象已成为困扰当今世界各国的一大社会问题。随着各国反腐败工作的进一步深入,如何从定罪上发挥刑罚的惩治和预防功能,成为各国政府和司法机关高度重视的问题。1948年日本昭和电工案和1976年的洛克西德案,使日本刑法增加了贿赂犯罪的罪名,同时加重了对贿赂犯罪的法定刑。中国刑法在罪名体系的设置上存在一定的问题。文章通过对中国刑法典与日本刑法典和《联合国反腐败公约》中关于贿赂犯罪罪名的比较,提出了中国应当建立科学的贿赂犯罪罪名体系。     

对我国信用卡诈骗罪立法的反思与建议

信用卡诈骗罪是97年刑法规定的一个新罪名，它为司法机关打击“使用伪造的信用卡扣作废的信用卡”、“冒用他人信用卡”和“恶意透支”的行为提供了有力的法律支持，但是现行法律在该罪名的认定上仍然存在一些值得推敲的地方，笔者就此提出了自己的看法。     

论刑法定量因素的设立

定量因素应当是在立法过程中被设立的。但是，定量因素的完善离不开司法机关主观能动性的发挥。应当由国家一级的立法机关对情节加重犯中定量因素的种类做出明确的规定，由各省的立法机关参照种类的规定，根据最高立法机关设立的制定系数的原则，结合本省的实际情况对权数予以设定。之后，由司法机关完成相乘之后的相加，即对于复杂案件采取“加权求和”的方法。

A clique-transversal set S of G is a set of vertices of G such that S meets all cliques of G. The clique-graph of G, denoted as K (G), is the graph obtained by taking the cliques of G as vertices, and two vertices are adjacent if and only if the corresponding cliques in G have nonempty intersection. Let F be a class of graphs G such that F={G|K(G) is a tree}. In this paper the graphs in F having independent clique-transversal sets are shown and thus TC (G)/|G|≤1/2 for all G ∈ F.
