"依法治校"还是大学自治?

"依法治校"是教育行政部门提出的一个口号,但是,这个口号对大学的适切性值得研究。总体上说,大学不是一个公共权力机构,所以,大学不宜成为"依法治校"的主体;大学的自身特点使其不宜完全由法律来治理。以"依法治校"替代大学自治既不合于大学的法律地位,又有悖于大学的传统,也不利于大学的健康发展。     

现代大学制度建立与运行的法制保障研究

"没有无权利的主体,也没有无主体的权利";法制保障是现代大学制度建立与运行的"护身符"。这种法制保障须从三方面建立:一是赋予大学法人主体地位;二是建立现代大学法人治理结构,充分发挥校长依法治校的作用,并建立起董事委员会对校长行为进行监督管理的机制;三是制定大学法人治校章程。     

依法治校:现代大学发展战略的支点选择

依法治校是依法治国理念在教育领域的具体表现,作为现代大学发展的战略支点选择,具有较为深刻的法理内涵,赋予了大学各主体不同的法律责任。推进大学依法治校工作,必须理清大学的内外部之间的关系,明确其层次性与特殊性,并通过法律制度的构筑、法治价值观的更新、法治化大学治理结构的形成、司法体制机制的建立、法治高等教育文化的形成进一步巩固依法治校的战略地位。     

论“依法治校”与“以德治校”

依法治校是推进教育法制建设的重要内容,以德治校是教育内涵发展的内在要求。治理学校,应当把"依法治校"和"以德治校"有机结合起来,做到德法并举,内外结合,标本兼治。

党的十八大提出了全面推进依法治国的重大决策和战略部署,十八届四中全会首次以依法治国为主题,可见依法治国是今后我国各个领域改革和发展的核心。在教育领域,《国家中长期教育改革和发展规划纲要(2010-2020年)》明确提出实施依法治校;教育部制定的《全面推进依法治校实施纲要》阐述了依法治校的重要性、指导思想和具体要求。针对我国高等教育领域全面推进依法治校的需要,基于依法治校关键层面的系统分析和西交利物浦大学依法治校的实践,为国家和高等学校实施《全面推进依法治校实施纲要》提出如下经验和建议:高等学校可从章程、治理结构、管理机制、师生权利保障、依法治校文化等方面的完善全面推进依法治校;国家制定大学组织法明确大学的法律地位,并通过法律保障各类高校平等获取资源的权利;引导全社会增强法律意识和建设遵纪守法的文化。     

依法治校与大学章程建设的理论与实践探讨

加强大学章程建设是完善现代大学制度的重要环节。大学章程的性质和地位决定了其在高校依法治校过程中的重要地位。吉林大学较早地提出了依法治校战略,进行了大学章程建设的探索实践。以大学章程的修订和新形势下推进依法治校为契机,全面总结经验,提出新的思考,对我国高校开展依法治校和加强大学章程建设具有借鉴意义。     

刍议高校大学章程的价值与作用

高校作为一个独立运行的社会组织,在社会发展中起着举止轻重的作用,要构建现代化的高校治理体系,提高高校的治理能力与管理水平,就需要有一个规范完备的制度体系作为支撑力量。依法治校是依法治国的重要组成部分,大学章程作为高校中的"宪法",是高校依法治校的前提条件。构建高校的大学章程,能够界定好学校与政府、学校与企业、学校与社会等诸多方面的关系,真正实现"党委领导、校长负责、教授治学、民主管理"的现代大学制度;同时也是高等职业教育长期健康可持续发展的制度保障。     

近十年国内大学章程研究的热点——知识图谱的新视角北大核心CSSCI

笔者综合运用文献计量、知识图谱和社会网络分析方法,绘制近十年来国内大学章程研究的关键词知识图谱,揭示出近十年来我国大学章程研究热点集中于现代大学制度、依法治校、大学治理、教职工代表大会、大学自治、学术自由、高等教育法、制定程序、办学自主权等问题。"现代大学制度"节点的三个"三角形"知识图谱,揭示出"现代大学制度"、"依法治校"与"大学章程"、"地方政府"、"教职工代表大会"的内在关系。"大学章程"节点知识图谱,揭示出已有研究偏重于制定什么样的大学章程,而对如何制定、如何执行大学章程的研究还不足。     

大学不宜"依法治校"?

依法治校是依法治国的本质要求和体现,是依法治教的必然要求和重要组成部分;大学依法行为的必要性不容置疑,大学是依法行为的主体;依法治校绝非等于政府部门特别是教育行政部门对大学的直接干预和管理,大学的特殊性不能成为大学不宜依法治校的理由,大学办学的自主权只有在依法治校的前提下才能实现。

Let F be a class of graphs G such that F={G|K(G) is a tree}. In this paper the graphs in F having independent clique-transversal sets are shown and thus TC (G)/|G|≤1/2 for all G ∈ F.
