国际私法课程教学改革探讨

2011年8月,教育部针对我国对高等教育法律人才培养方面的严重不足,推出了实施卓越法律人才教育培养计划,旨在通过研究制定法律人才培养国家标准、创新卓越法律人才培养模式,分类培养一批高素质的应用型、复合型执法、司法职业法律人才和涉外法律事务高端人才。作为调整涉外民商事法律关系的国际私法,对其课程进行教学改革不仅是我国法学教育改革的必然要求,更是国际民商事关系迅猛发展的迫切需要。在我国法学教育已被定位为职业教育的前提下,从教育理念、教材体系和教学内容、教学方法以及考试方法等诸方面对国际私法教学进行变革显得异常紧迫。     

论我国国际私法教学的本土化

法律制度是法学的主要研究对象之一,国际私法是舶来品,三十多年来我国涉外民商法律和涉外民商事司法的积累,为我国国际私法教育的本土化提供了充分条件。必须尽快实现国际私法教学体系、内容、方法的本土化,突出我国涉外民商法律的地位和涉外司法成果,为促进我国涉外民商事交往培养高素质人才。     

涉外法律人才培养模式的审视

本文认为,涉外法律人才的培养应立足中国法学教育的现状。由此,从我国现阶段法学本科教育中师资队伍的配备、课程体系的设置和实习基地的选择等方面,论述了如何合理建构涉外法律人才的培养模式。

我国目前法学本科教育的主要目标仍是培养法律从业者,包括法官、检察官、律师、仲裁从业人员等.从目前涉外民商事案件司法实践来看,高等院校培养的法律本科毕业生无法胜任涉外民商事案件的处理,不具备国际私法意识和国际私法思维,理论和实践严重脱节.高校国际私法课程应从涉外民商事案件审理流程入手,改革现行的教学内容和教学方法,培养合格的法科毕业生以应对涉外民商事关系繁荣发展的国际经济一体化大潮.

解读《卓越法律人才教育培养计划》

实施"卓越法律人才教育培养计划"的依据是从法律人才的质量反观法学教育的质量的认识结果。这项计划是为弥补不足而为的补救。从法律人才队伍现状发现的法学教育的不足主要有三,即:①教育培养应用型、复合型人才不足;②教育培养涉外法律人才不足;③教育培养西部基层需要的法律人才不足。教育培养涉外法律人才不足、教育培养西部基层需要的法律人才不足和教育培养复合型法律人才不足,可以归结为"供求关系"上的不足,而影响应用型人才培养的实践教学不足是我国法学教育普遍存在的不足,是我国法学教学质量上的欠缺。弥补实践教学的不足是所有法学教学单位共同面临的任务。     

浅论法学教学改革——以国际私法教学改革为视角

国际私法在法学本科教育中有着重要的地位。各大院校的法学专业都无一例外地开设这一课程。但是国际私法的教学却一直存在教学内容庞杂、教学体系不集中等问题,这使得学生在学习国际私法时往往难以消化继而深入了解、掌握国际私法相关知识。作者根据现行国家法学教育政策和价值取向,探索出适合本科法学教育的国际私法教学改革的新路径,为国际私法教学改革作出应有的贡献。
