论原告住所地原则在网络侵权案件管辖中的确立及其规制

最高人民法院对网络侵权案件管辖的司法解释存在缺陷,我国应在网络侵权案件管辖规则中确立原告住所地原则,同时应借鉴国外不方便法院原则对其进行必要规制。基于此,对我国应采取的网络侵权案件管辖规则提出了相应措施。     

我国涉外网络知识产权侵权法律适用问题研究

不同于传统的知识产权侵权案件,网络知识产权侵权案件由于网络空间具有的虚拟性、开放性等特点,导致其侵权主体不易识别、侵权事实难以认定、侵权行为地难以认定。目前,我国对涉网知识产权侵权案件采用的仍是以被请求保护地法为基础的法律适用制度,不仅滞后于现代冲突法的灵活化、弹性化发展趋势,对于涉网知识产权案件而言也缺乏针对性。针对这些问题,文章提出了我国可根据网络空间的特殊性,加快推进网络知识产权相关立法工作,完善涉外网络知识产权侵权行为法律适用规则等具体建议。
