金融服务贸易自由化与金融审慎监管的冲突与协调

目前，WTO《服务贸易总协定》（GATs）框架内的《金融服务贸易协议》（FSA）中，通过审慎监管例外原则、国民待遇原则、国际标准、国内规则相互承认、国内管制措施多边纪律、规定附加承诺和补偿权利以及《巴塞尔协议》，来协调金融贸易自由化和金融审慎监管的冲突。我国要合理吸收国际金融监管惯例，制订统一的《金融监管法》，构建以金融监管局为主的金融监管体制。     

WTO框架下外资银行市场准入监管的审慎性措施研究

外资银行市场准入监管问题与金融服务自由化有着密切的联系。WTO框架下有关审慎性措施的规定体现了金融服务贸易自由化对各国金融监管的双重要求。本文主要通过分析GATS中的审慎性措施的含义以及判断标准,指出了我国外资银行市场准入监管的若干问题,并对如何进一步充分利用审慎性措施来完善我国外资银行市场准入条件提出相应建议。     

《金融服务贸易协议》背景下：我国银行业面临的挑战及对策

1997年12月13日在日内瓦达成的《金融服务贸易协议》（WTO‘s Financial Services Negotiations)，作为《服务贸易总协定》（GATS）的重要组成部分，对各国金融业产生重要影响。1999年11月中国与美国就中国加入WTO达成协议，该协议标志着中国加入WTO取得了重大进展。根据中国WTO谈判的情况表明，预计2001年中旬，中国有望加入WTO，该协议也将对我国金融业产生重大影响。因此，有必要对《金融服务贸易协议》的背景及内容进行了解、分析我国面临的问题及应采取的对策。     

我国对外贸易法完善之对策研究

我国改革开放和加入WTO的过程和结果首先应是按照WTO规则和我国在加入WTO谈判中的承诺，全面充实、 调整和完善现行的外经贸法律、法规和规章，以建立起一个统一、公正和透明的外经贸法律体系，而作为我国对外经济贸易基本法的《对外贸易法》则首当其冲，应从其立法原则、外贸经营权、外贸代理制、服务贸易等方面加以完善。     

完善我国外资银行监管制度的法律建议

按照加入世界贸易组织的承诺,我国已于2006年年底向外资银行全面开放了国内金融市场,在过去的一年多时间里,外资银行的大量涌入给我国金融业既带来了前所未有的机遇同时也带来了巨大的挑战,如何在立法层面上更好地规范外资银行就成为目前亟需解决的问题。本文从分析我国《外资银行管理条例》特点入手,在结合外资银行在华发展现状基础上,为完善我国外资银行监管制度提出相应的法律建议。     

论我国反补贴案件的司法审查制度

对反补贴措施进行司法审查是WTO反补贴程序法的一项基本内容。根据我国加入WTO的承诺,先后颁布的《中华人民共和国反补贴条例》和《关于审理反补贴行政案件应用法律若干问题的规定》对司法审查作了明确规定,初步构建了我国反补贴司法审查的法律制度。司法审查是反补贴措施法治化的标志,我国反补贴司法审查制度具有创新之处。
