论经济全球化时代的国家主权

作为当代世界发展的潮流，经济全球化对国际法理论产生了巨大的影响，传统的主权观念日渐与时代的发展不相适应。国家主权理论在经济全球化的进程中面临着严峻的冲击和挑战，主权否定论、主权让渡论等各种思潮涌起。在经济全球化的背景下。民族国家应树立新的主权观念。即在未来的国际实践中。国家主权始终是国际社会的基础。其至高无上的地位不可动摇。在此前提下，国家主权可以在平等的基础上受到限制和进行让渡。     

经济全球化对国家主权的侵蚀与中国的应对

在经济全球化趋势下，国家主权正受到越来越严重的侵蚀。经济全球化对国家主权制约的强度日益增大。在经济全球化进程中处于主动地位的国家，才能更好地维护国家主权。面对经济全球化的挑战，发展中国家应通过制度创新，主动参与经济全球化进程，以有效维护国家主权。在21世纪的激烈国际竞争中，中国如何争取更加主动有利的地位，更好地维护国家主权，作者提出了几点应对建议。     

全球化的内在矛盾

全球化是生产方式矛盾运动的必然结果 ,它在推动经济发展和社会进步的同时 ,也在经济、政治和文化上带来了一系列不可克服的内在矛盾。在资本主义主宰世界政治、经济和文化秩序的情况下 ,不仅资本主义固有的基本矛盾会不断激化 ,而且产生了一系列新的无法克服的矛盾 ,如跨国公司与国家主权的矛盾 ,跨国公司的效率追求与各国的公平要求的矛盾 ,知识的公共性与知识产权的专有性的矛盾 ,文化的同质性与异质性的矛盾等。全球化的内在矛盾为全世界无产阶级的联合以及资本主义向社会主义过渡创造了客观的历史条件     

经济全球化与国家主权的维护与创新

经济全球化如同一柄“双刃剑”,在部分削弱国家主权的同时也可能增进国家主权。要想趋利避害,既融入经济全球化的进程,又能坚持强化国家主权的立场,就必须在认识经济全球化与国家主权的逻辑互动关系的基础上,抓住经济全球化的契机,对国家主权理论进一步创新。     

经济全球化视阈下的中国国家主权问题分析

在经济全球化进程中,中国的国家主权面临着中国弱势与西方强势、民族性与全球性、社会主义与资本主义、和平稳定环境与非安全因素上升、政府调控与世界市场化的矛盾。这些矛盾使中国国家主权在社会制度、意识形态、国家安全等领域的行使中出现了新的问题。为此,中国必须构建国家安全、制度建设、市场发育、国际环境四位一体的国家主权应对战略。

重新审视经济全球化条件下的国家主权

国家主权理论产生以后受到世人普遍关注．特别是经济全球化的令天，传统国家主权理论受到严峻的挑战。面对挑战．要求我们远用辩证思维重新审视国享主权：一是国家主权原则性质变中有不变；二是国家主权原则体现的是国家最高利益原则；三是国家主权理论的新发展。重新审视经济全球化条件下的国家主权具有特别重要的现实意义：它有利于反对霸权主义．堆护发展中国家的主权；它有利于建立国际政治经济新秩序，维护世界和平；它有助于世界各国政府制定更加正确的对内对外政策。     

经济全球化中的新自由主义思潮与国家主权

经济全球化是我们这个时代最重要的特征之一。在经济全球过程中新自由主义思潮起了推波助澜的作用，新自由主义是作为古典经济自由主义的现代变种和凯恩斯主义国家干预的对立面而产生的，新自由主义主张削弱国家主权。然而自由主义思潮关于削弱国家主权的思想在经济全球化进程中的负面作用也显示了出来。世界经济的发展勾勒出越来越不公正和混乱的世界未来的前景。而作为这一时期占统治地位的新自由主义随之陷入危机。

在回顾马克思对经济全球化阐释的基础上，从马克思主义理论出发，解读经济全球化现象，并对当今经济全球化表现出的一些问题包括经济全球化的实质及其与失业、贫困化、阶级、国家主权的内在联系作初步分析和探讨。
