从现实司法实际中日益增多的代表人诉讼案件入手，以代表人诉讼相关的基本概念为基础，通过分析我国立法中有关代表人诉讼的规定，联系司法具体操作中存在的缺陷和不足对其程序操作中几个应重点把握的方面，如管辖等提出了自己一些不太成熟的看法，以期为今后代表人诉讼制度的日趋完善起到促进作用和达到抛砖引玉的效果。

关于《检察机关提起公益诉讼改革试点方案》中,对检察机关提起行政公益诉讼的规定及其没有做出明确安排的重要制度进行讨论与设计,试从司法实践出发,对检察机关提起行政公益诉讼的诉前程序、诉前程序与提起诉讼衔接机制以及案件范围进行分析与探讨。希望通过对上述法律程序的详细探讨与设计,建立起基本完善的检察机关行政公益诉讼制度与规则。为进一步深化司法体制改革,探索建立我国检察机关提起行政公益诉讼制度,提出启发性意见。     

日本知识产权民事诉讼制度及其启示

日本通过司法改革,建立了新的知识产权诉讼制度,目的是提高知识产权纠纷解决效率、更好地保护知识产权法律关系,以充分体现和落实知识产权立国理念。日本的知识产权诉讼在很多方面有自己的特点,比如建立了知识产权法院、专家参加案件的审理、法官可以对专利无效的抗辩进行审理、注重商业秘密的保护等。日本知识产权民事诉讼制度对中国完善知识产权诉讼制度的探讨具有启发意义。中国应借鉴日本经验建立知识产权上诉法院,保障知识产权专家参与案件审理,在知识产权侵权诉讼中引入无效抗辩制度。     

试论中国特色公益诉讼制度的构建

公益诉讼是当代世界各国尤其是法治国家为维护国家利益、社会公共利益、公众或群体公共利益和公平竞争的公共秩序而确定的一种新型的诉讼制度。长期以来 ,我国在公益诉讼立法和司法方面严重滞后 ,使国家利益、社会公共利益、公众或群体利益和公平竞争的公共秩序未能得到有效的司法保障 ,导致现实社会生活中侵犯公共利益的案件屡屡发生 ,且愈演愈烈。当前 ,尽快构建一个科学的、中国特色的公益诉讼制度是当务之急。本文从起诉主体资格、受案范围、诉讼时效、审判制度、举证责任、诉讼权处分、审判监督、诉讼费用、诉讼激励机制等方面来探讨中国特色公益诉讼制度的构建。     

诉讼欺诈的阻却与规制问题探析

由于民事诉讼立法的局限性,司法实践中对诉讼权利制约的软化,诉讼欺诈案件在我国呈上升趋势,成为新闻媒体和社会公众关注的热点。利用诉讼的手段达到损害他人权益的目的无疑是对法律公平正义价值的忽略与践踏,对此必须严格禁止和防范。本文着眼于诉讼欺诈规制,立足于审判实践,试图从认知和识别诉讼欺诈出发,揭示了当前诉讼欺诈泛滥的深层原因在于规制法律的局限与缺位,并提出防范诉讼欺诈的司法阻却对策和完善规制诉讼欺诈的法律制度。

根据国情充分借鉴美国等西方国家科学的制度设计和成功的司法经验是中国建立完备的环境公益诉讼制度的最优选择。文章以比较法学为研究范式,以实证考察为研究方法,从原告资格、诉讼类型、诉讼限制、救济途径和配套制度等五个方面对美国环境公益诉讼制度——＂公民诉讼＂制度作深入探析,并详细阐述其对中国的启示和借鉴意义,希望能对中国未来的环境公益诉讼制度有所裨益。     

论恶意诉讼的检察监督

恶意诉讼不止损害相对人和第三人的利益,更为严重的是其浪费司法资源,扰乱司法秩序,危害司法公信力。恶意诉讼隐蔽性、表面的合法性等特点加剧了识别的难度。虽然我国民事诉讼法对恶意诉讼有了第三人撤销之诉、案外人异议之诉,民事强制措施等规制方式,但对恶意诉讼的震慑作用仍不足。因此,要从检察监督的角度识别恶意诉讼案件,充分发挥检察机关的监督作用,落实对恶意诉讼案件责任的追究等方面进行规制。     

一般保证合同纠纷诉讼程序研究

债权人在未对主合同纠纷提起诉讼或者申请仲裁的情况下,仅起诉一般保证人时,《民诉法解释》和《担保制度司法解释》分别作出了追加债务人为共同被告和驳回起诉的规定,从而导致司法实践适用法律混乱。通过厘清保证责任承担的顺序性的实体法内涵和诉讼法上的实现方式,以及保证合同的从属性在诉讼中的表达,纠正偏离诉讼法原则的适用法律行为,构建实体法与诉讼法衔接的一般保证合同纠纷诉讼程序。债权人仅起诉一般保证人时仅按照单一诉讼处理,并配合无独立请求权第三人制度就能实现案件事实的查明。
