信访制度与农民利益维护

现有环境下农民利益受损理性选择信访制度，信访制度一定程度上维护了农民的利益，但也存在局限。改革完善信访制度，维护农民利益，要坚持以人为本，科学决策，民主决策；畅通农民利益表达和维护渠道，及时化解矛盾，缓和冲突；实施法律援助，实现司法公平公正；高度重视信访工作，将大量矛盾问题解决在基层。     

失地农民利益保障问题探究——以南京市一起失地农民集体上访事件为例

笔者通过对南京市C街道一起失地农民集体上访事件进行剖析,发现政府给失地农民的补偿及安置不合理、失地农民转业和就业困难、失地农民社会保障制度缺失是当前失地农民利益保障机制中存在的主要问题.在此基础上,笔者指出了失地农民利益保障机制缺失给农民家庭和社会治安造成的不良影响.最后,借鉴一些地方安置失地农民的成功经验,提出了多策并举解决安置问题、出台就业促进措施保障农民利益、建立长效补偿机制改善失地农民境况等建议.     

新农村建设必须完善农民利益表达机制

完善农民利益表达机制是新农村建设的重要内容,是党夯实执政基础的重要途径,是维护农民权益的重要举措。我国现行农民利益表达机制存在着农民利益表达机会不平等、农民利益表达缺乏组织化、农民制度内利益表达渠道不畅通、农民非制度化利益表达上升等问题。完善农民利益表达机制要从建立农民利益表达组织、完善农民利益表达的制度与法律保障和保障农民利益表达机会平等等方面入手。     

集体土地征收中农民利益表达机制的构建——以基层社会稳定为视角

现有集体土地征收制度,过于向征地政府倾斜,使得在征地的公益属性认定、征地补偿等方面,没有很好地兼顾到被征地农民的合法权益,导致征收权的行使与被征地农民合法权益保护之间的利益平衡被打破,土地征收与补偿纠纷频发。突出农民的主体地位,健全农民利益表达的机制,在征地政府与被征地农民之间搭建起利益沟通、协商的平台,建立被征地农民利益影响集体土地征收与补偿的约束机制,是完善集体土地征收与补偿制度的关键。     

城中村农民利益表达面临的困境及对策分析

城中村农民的利益表达面临着制度内利益表达渠道不畅通、非制度化利益表达呈上升趋势、利益表达缺乏组织性等困境,政治制度建设滞后、城中村农民的政治素质低、利益表达缺乏组织性是城中村农民利益表达面临困境的主要原因,为此,必须从健全城中村农民的利益表达机制、提高城中村农民的政治素质及组织化程度等方面入手来提升城中村农民的利益表达水平。     

当前农村谋利型上访凸显的原因及对策分析——基于湖北省江华市桥镇的调查研究

学界主流的农民上访研究都在维权话语下展开,学者们也大多认为解决农民上访问题的出路在于畅通信访渠道,健全利益表达机制.这些观点尽管捕捉到了当前信访问题的某些侧面,却未能提供一套有效的解释,从而难以提出有针对性的对策.其实,当前农村信访问题出现一些新特点,其突出表现是谋利型上访的凸显及蔓延,给基层信访治理工作带来不利影响.农民上访问题恶化的重要原因在于乡村社会价值观的混乱与健康政治文化的缺失,为缓解农民上访问题,亟需加强适应现代国家建构目标和要求的政治文化建设.     

新时期农民信访存在的问题及对策分析

我国现存权利救济体系薄弱导致农民上访无序,信访机构权责错位现象严重,农民信访消耗成本高且效率低等种种问题的存在使得农民在维权的道路上步履维艰。本文阐述了农民信讨中存在问题的原因,即农民传统维权思想根深蒂固、农民信访制度体系存在缺陷、农民寻求司法救济成本压力重。为解决农民信访问题应当构建科学且规范的农民信访体系作为制度保障,建立统一的信访管理机构来提高解决问题的效率,发展与完善信访代理制度来有效保障农民的信访权利,同时对农民进行理性信访的宣传教育等多种措施来解决农民信访存在的问题,使得农民信访制度体系更加完善。     

我国农民利益表达机制的完善

目前我国农民利益的表达存在许多问题、主要有法律制度不完善、表达渠道单一化等,使得农民进行利益表达时陷入困境,往往采取极端、非制度化的表达方式.这对和谐社会造成消极影响,增加了不稳定因素.中国共产党十五届三中全会以来,更加注重农民利益问题.因此,亟须完善我国农民利益的表达机制.     

征地补偿义务主体的制度困境与策略分析

国家征地补偿行为涉及政府、用地单位及农民集体等群体,由于《宪法修正案》中关于征地补偿立法规定的不明确,使得土地征收方、被征收方之间存在着土地权利与经济利益的纠纷。面对国土征地存在的法律缺陷、制度不完善问题,需要从博弈论、合作论视角下进行分析,通过制定更加明晰与规范的土地产权制度、征收补偿条款,规制与督促征地补偿主体行使义务,增强用地单位、农民集体的沟通合作与矛盾协调,从而推动征地补偿机制建设、利益分配的双赢。     

论信访现象的内卷化

信访现象的勃发,在制度上源于信访者利益表达困境,在观念上源于对最高权力的迷信,以及个案有效性支持下的路径依赖。信访问责考核机制构成了地方政府接访、压访的动因,加之信访机构职能的虚化导致的信访积压,更激发了上访者的动力,强化了上访群体的认同感,形成了信访的新样态,导致一轮又一轮上访潮。地方政府基于中央维稳考核的压力下,信访机构数量膨胀,反而让信访反官僚主义功能日益被自身的官僚化所取代,由此形成了信访制度自身强化的悖论,信访现象内卷化的循环。
