论留置物的性质对留置权善意取得的影响

国内外立法实践中,多数国家的法律均将留置物的范围由债务人的财产扩大到了他人财产。然而我国学界一般将其误认为是留置权善意取得的立法例,并未认识到其作为留置权成立条件的真正内涵。留置权的善意取得,主要应取决于留置物性质。当留置物为占有委托物时,留置权的取得不宜适用善意取得制度,留置权应依担保法一般规定成立;当留置物为占有脱离物时,若债权人为善意,留置权的取得应适用善意取得制度。     

同一物上数个不同担保物权的实现

同一物上存在数个不同的担保物权时,其实现的原则在理论上有设定优先原则、登记优先原则、占有优先原则和法定优先原则。在先押后质情形下,动产抵押权和动产质权的实现贯彻以设定优先原则为主、以占有优先原则为补充的规则;先质后押时,质权的效力应优先于抵押权。先押后留情形下,留置权优先于抵押权; 先留后押,视情况决定后成立的抵押权是否优先于留置权。先质后留情形下留置权优先于质权;先留后质时多数情形下质权优先于留置权,一般情况下成立在先的留置权优先于在后质权     

简论留置权之成立要件

债务已届履行期限,债权人有权对依合同合法占有的债务人财产行使留置权.为了正确行使留置权,本文拟就留置权成立之要件进行探讨.     

论留置权的特性

作为物权的留置权的法律性质,我国学术界主要有几种不同意见,但笔者认为更能全面体现我国《担保法》中所规定的留置权的法律性质,应为如下六性：担保物权性、法定性、占有性、二次效力性、替代性、可分性。 一、担保物权性 首先,留置权为物权。从我国现行法的规定中可以看出留置权的物权性体现在：它是直接以物为标的的权利,其效力直接及于留置物;留置权人得排他地占有留置物,其不仅可以对抗债权人的返还请求权,而且可以对抗一般第三人,具有物权对世的效力;留置权人于一定条件下可以直接支配留置物,可以直接从留置物的价值优先受…     

论商事代理留置权

商事代理留置权是商事代理人享有的一种特殊权利,具有保全商事代理人债权的功能。商事代理留置权是建立在商事留置权的基础上,以商事代理独立于民事代理制度为前提。它具有民事留置权的一般特征,其形成条件受制于商事代理的营业性特点。商事代理留置权有拒绝返还的抗辩、留置物的处分以及优先清偿的法律效力。     

论留置权成立要件之“同一法律关系”

留置权作为一种古老的债务担保方式,在市民生活中发挥着重要的作用。域外大陆法系将民事留置权界分为物权性留置权和债权性留置权,以牵连关系为路径进行建构。我国《物权法》第231条规定留置物应与债权具有"同一法律关系",该限定过于严苛。借镜域外相关规定,结合我国法制发展脉络,我国民事留置权的适用范围应予以扩大,将"同一法律关系"向"牵连关系"扩张。同时,在民法典物权编立法中,亦应对商事留置权和特殊留置权进行反思与重构。     

留置权限制探析

《物权法》设立和明确了一些重要的物权法律制度,其中对于留置权法律制度,《物权法》改变以往的法定原则,扩大了留置权的适用范围,建立了商事留置权制度,明确了留置权优先于抵押权和质权的原则,这对保证经济生活中债权的实现具有重要意义。但是,对留置权是否应受某种限制这一问题,学界一直存有很大的争议。因此,有必要结合国外立法对留置权限制的相关规定,从我国《物权法》和《担保法》出发,从留置权的设定、标的物的限制等方面对留置权成立的限制及其相关问题进行研究和分析,并结合实务对留置权限制的操作规则进行说明。

The Reader Response Approach to Teaching of English Literature

During interview with English majors, it was found that a majority of students expressed disappointment with their experience of English literature classes. Students' dislike of learning English literature appears to be the major problem of teaching English literature in China. Reader response approach is a good way to solve this problem. In this paper, I explain the rationale behind the reader response approach, such as its origin, definition, features, assumptions, and strategies. Then I illustrate how reader response approach works as a teaching strategy by presenting several teaching models. At last I evaluate its usefuiness for teachers and present the advantages of reader response approach in Chinese context.
