试论犯罪实行行为着手的含义

犯罪实行行为的着手是确定犯罪实行行为已经开始的标志,是区分犯罪预备和犯罪未遂形态的唯一判断方法。因此,对着手的认定是犯罪实行行为的核心问题。传统德日刑法理论关于着手的认定主要有主观说、客观说和折中说,但是都具有种种缺陷,导致无法科学地认定着手。我国刑法理论的通说对于着手含义的理解是正确的,既是主客观相统一,又是事实判断与价值判断的统一。     

性贿赂不宜犯罪化的刑事政策分析

我国刑法中界定贿赂的范围限定在＂财物＂二字,虽然最高人民检察院在2007年发布了《办理受贿刑案意见》,其中明确财产性利益属于受贿的范围,然而对于＂性贿赂＂等非财产性利益并无其他明文规定,这也导致性贿赂问题变成了争论的焦点。鉴于宽严相济刑事政策首先要求就是谦抑主义背后的非犯罪化趋势,本文认为可以从刑事政策角度理性分析性贿赂不宜犯罪化问题,这也是笔者的基本立场。     

环境犯罪刑事违法性理论研究

环境犯罪作为我国刑法诸多犯罪类型中的一种,当然适用传统的犯罪构成理论,而刑事违法性是我国传统犯罪理论中犯罪构成最基本的要件。然而,环境犯罪作为一种新兴的犯罪类型,有其自身的特性。环境侵害的多元价值性使得传统的刑事违法性理论对于环境犯罪适应困难。＂行为无价值＂与＂结果无价值＂作为环境犯罪违法性的认定标准显得问题诸多。因此,提出＂容许性危险犯＂以弥补、更新环境犯罪刑事违法性理论。     

结果犯概念比较研究

大陆法系刑法理论的结果犯是指构成要件中规定了构成要件行为和结果的犯罪,与犯罪停止形态没有直接关联,立法规定结果犯体现了结果无价值的倾向;我国刑法理论的结果犯是指结果发生为犯罪成立标志的犯罪,是犯罪成立意义上的犯罪类型。结果犯的结果,有的根据法规范特征可以得到简明判断,有的需要进行实质的犯罪论解释。结果犯作为行为犯相对应的犯罪类型,只有犯罪成立与否的问题,不存在犯罪未完成形态之分。     

复行为犯之着手

在刑法理论中,研究单行为犯罪是常态.对单行为犯罪的相关问题,如概念、特征、犯罪停止形态以及共同犯罪形态等问题,都作了深入的理论探讨,形成了为大多数学者所认可的通说观点,具备了相当成熟的理论框架.然而,与单行为犯罪相对而言的复行为犯罪,则亟需诸多刑法学者的广泛关注.因为复行为犯罪不仅仅是行为数量上的简单叠加,更有其重要的存在价值.本文从复行为犯的着手入手,深入研究复行为犯着手的认定.旨在充分建立和完善复行为犯理论体系,更好地解决司法实践中复行为犯所面临的着手判断之难题.     

保险诈骗罪犯罪既遂与未遂形态比较研究

本在比较世界主要国家保险诈骗罪之犯罪既遂与犯罪未遂形态理论的基础上，认为，中国刑法中的保险诈骗罪是复合实行行为，其着手时点应以行为人开始实施虚构保险标的，编造未曾发生的事故，夸大损失程度，制造保险事故的行为为标准，中国刑法对保险诈骗罪犯采用了结果犯的立法模式，因此，其既遂应以行为人可否实际控制保险金为标准。

运用刑法手段打击环境犯罪必须解决环境犯罪客体的界定问题。从评析环境犯罪客体的有关学说、马克思主义法学关于犯罪本质的一般认识、犯罪客体的两大学说、刑法内部结构协调一致性的要求、打击环境犯罪的司法实践等角度出发,应将环境犯罪的客体界定为环境权。     

浅谈目的犯

目的犯是以特定的犯罪目的为构成要件的一类犯罪,但作为犯罪构成要件的犯罪目的必须限于刑法的明文规定。尽管我国目前刑法理论界的通说是作为目的犯的特定犯罪目的不以刑罚的明文规定为限;但是基于罪刑法定、打击犯罪、司法操作等反面的考虑,绝不能不能从理论上任意扩大目的犯的范围。对于目的犯之目的的本质,犯罪动机说已为我国很多学者所采纳,而且也有不同于犯罪目的说的其他学说兴起。犯罪动机的本质属性在于其是一种纯主观的心理需求,它不能直接观察测量,只能根据刺激或反应去推测,不具有客观性。作为刑法明文规定的目的,其本质只能是可以外化的,可以衡量的具有客观性的犯罪目的。
