Abstract

Over time changing circumstances in legal education, scholarship and practice influenced law school library collections. Currently, increased demands for non-legal material and new technological enhancements are changing the law school library's environment. As a result, cooperative and collaborative collecting activities are flourishing between the University of Denver's law school library and its general library despite the autonomous administrative structure of the law school library.     

《普通高等学校图书馆规程(修订)》与 "图书馆法"

《普通高等学校图书馆规程(修订)》对指导高等学校图书馆的工作必然会起到非常大的促进作用．但是行政规定和文件往往只是指导性、建议性和行业性的,在具体实施的过程中可能会因多种因素影响他们的落实和实施,不可避免的具有一定的局限性。如果行政文件再附以相应的图书馆法规或者在《规程》中多明确一些图书馆的权利和自主等,我国高等学校的图书馆工作将会有更大的改进。     

Stuck Behind the Curve: How the Academic Law Library Can Help Students Who Struggle in Law School

This article examines how academic law libraries can assist law schools in meeting the needs of students who struggle in law school. This article will describe the types of programs currently available to help struggling students within law schools, including academic support programs, and offer suggestions to improve the delivery of services to this growing population.     

中学图书馆利用对中学生学业表现的影响研究——以苏州市A中学为案例

考察案例中学学生对图书馆的利用对其学业表现是否有影响、图书馆各项服务设计与其影响的关联、学校图书馆的帮助方式。结果显示,在该校目前的教育状况下,图书馆利用与学生学业表现间不存在统计学上的相关关系;在学生和教师的感知中,学校图书馆有不同程度的帮助,但效果并不明显;图书馆服务设计中仅三项能够对学生的考试成绩产生影响;学校图书馆的帮助主要体现在对学生阅读能力的影响。本研究进一步发现,是目前的教育状况(注重素质教育的形式、忽视真正的能力培养)掩盖了学校图书馆价值的展现,并限制了其作用的发挥。     

数字图书馆多重法律地位及版权法律重构

数字图书馆具有多重法律地位,可以作为最终用户、普通ICP、数字传播媒体、作品传播者,也由此对版权法提出了挑战。文章提出基于豁免权的版权法律重构,给予数字图书馆特殊合理使用权和特殊豁免权。     

基于电子政务的党校图书馆角色使命

论述了党校图书馆如何认清新时期自己的角色使命，把自己所扮演的角色提升到一个新的高度，进一步扩展自身的职能使命，以至能够在电子政务发展高潮中抢占一席之地，有所作为。     

The Rise and Fall of Academic Law Library Collection Standards

This article provides a history of the American Bar Association (ABA) Accreditation Standards for law library collection development from a simple standard, “adequate for the use of the students,” to a more detailed list of requirements, and back again to simpler mandates. ABA standards are currently under review, and the author argues it is time to end the collection requirements in the ABA standards.     

Reflections on Managing a School Library

The school librarian is a manager — despite what others and they themselves might believe. The school library management experience resembles that of the public, special, and academic library. There are common issues of self-sufficiency, conflicting roles, problematic patrons, and lack of respect. School library managers face unique challenges as well. They often have unusually constricted budgets, dubious personnel support, little time to plan, and facilities that are routinely co-opted for other purposes. They are expected to be technology experts and teach on a regular basis. They act as “loco parentis” for their patrons. They must not just promote their services but advocate for their existence. Graduate library schools often offer few courses in school library management for a variety of, usually economic, reasons. Traditional management courses should be supplemented by in-the-field experience and observation as well as input from practicing school librarians. In conclusion, I offer a wish list of school library management tips from my 30+ years of experience.     

Placemaking in the Academic Law Library

Public and university libraries have embraced placemaking theories to develop user-centric library spaces. Placemaking has largely been overlooked in the context of academic law libraries. This article explores the range of space planning choices available to law libraries as they downsize their print collections. The benefits of reimaging law library space using placemaking concepts are explained.     

试论日本学校图书馆专业职务制度对我国中小学图书馆发展的启示

本文通过对我国中小学图书馆发展现状的分析,得出"图书馆人员问题"是目前中小学图书馆发展之关键所在,并针对日本较完善的学校图书馆专业职务制度从多方面进行详细地分析与研究,论述其对我国中小学图书馆事业发展的启示,并提出了一些建议。     

以司法实践审视图书馆法的制定

推动图书馆立法的策略应重视图书馆实践与司法实践相结合,一方面积极行动起诉或应诉,另一方面研究图书馆作为诉讼主体的司法案例,总结各种可指导司法实践的应用理论,以司法需要推动国家立法。     

Reimagining the Wheel: Using Circular Calendars for Planning in Law School Libraries

This essay proposes using a wheel or circular calendar to identify and document the events and projects of an academic law school year, both in and out of the classroom. The idea of harnessing the natural cyclical process of law school for library planning comes from concept mapping, which can conceptualize an issue by using a variety of mapping strategies to organize and show the relationships between pieces of information and a central concept. Using a wheel graphic to visualize a process can facilitate project management and aid in teaching legal research strategy.     

日本图书馆法框架下的图书馆业务建设

日本是世界上图书馆事业较为发达的国家之一,在图书馆建设方面的成就有目共睹。不仅有图书馆法作为保障,更有合理的图书馆架构及图书馆间的合作。文章着力探讨日本图书馆法基础、修改与图书馆间合作结构的关系,希望能够对我国图书馆间的合作起到参考作用。     

论新著作权法对数字图书馆建设的影响

文章从数据库的法律保护、合理使用范围的缩小、法定许可的运用、著作权集体管理组织的建立及技术措施的法律保护等方面对这一论题进行阐述；指出数字图书馆在主动适应新形势的同时，政府应给予其政策上的优惠、财政上的支持，以加快数字图书馆建设的进程，使其朝着健康有序的方向发展。

从行政法律关系、劳动法律关系和民事法律关系等三个方面论述了公共图书馆法律地位的内容和特征，以期明确公共图书馆的权力和义务。

世界图书馆立法已有160多年的历史,经历了立法早期、立法普及期、立法网络化发展期3个阶段,形成了较为成熟的立法理念。网络环境下图书馆立法的焦点是"公权"与"私权"的调控和兼容,因此我国《公共图书馆法》的立法过程中应明确图书馆法权,明晰图书馆法权体系,依据《中华人民共和国宪法》和《中华人民共和国立法法》的规定,对立法程序、立法权限、立法范围、法律解释、运用规则、立法监督等进行全方位的条例化陈述。

简要介绍日本图书馆法从产生到形为比较完备的法律体系的演进过程, 详细论述日本几部图书馆法产生的经过、背景和主要内容，指出它们对当时日本图书馆所产生的影响与推动作用。希望通过研究日本图书馆法的发展历程，对我国的图书馆法制建设提供启示及借鉴。
